The clips you just received are a sneak peek at a possible future of politics in America. During this retreat we’re going to explore four very different “scenarios” that have been developed for this strategy retreat through research, interviews, and workshops.

What are scenarios and what is scenario planning?
Scenarios are stories about possible futures. In an uncertain time for American politics, the Democracy Fund has chosen to use scenario planning to take a longer view of the threats facing American democracy. We hope scenario planning will help us consider the unpredictable future and explore the strategic implications.

What is our objective?
Our objective in this retreat is to tap into your experience, creativity, and expertise to ensure the Democracy Fund remains focused on our mission, and is prepared to meet tomorrow’s challenges.

At this time, the Democracy Fund is organized as an invite-only grant-making process, in which potential investees are contacted to begin the grant application process. The Democracy Fund does not accept unsolicited business plans, proposals, or personal requests. Any submitted materials marked proprietary or confidential will be discarded.

Privacy Policy

This Privacy Policy (“Privacy Policy”) is designed to help you understand generally how Democracy Fund, Inc. and its affiliates (collectively “DF”) collect, use and disclose certain information about you in connection with the website on which this Privacy Policy is posted, democracyfund.org (the “Site”).

By using or accessing the Site, you expressly consent to our collection, use and disclosure of information in accordance with this Privacy Policy. This Privacy Policy is effective upon your first use of or access to the Site.

Information We Collect.

Personal Information. “Personal Information” means information that personally identifies you, such as your name, phone number, mailing address or email address.

Submitted Information. DF may collect Personal Information about you when you submit such information to DF through the Site or otherwise (“Submitted Information”). For example, DF may collect Personal Information such as your email address to send out periodic updates regarding DF. DF may, in the future, include other requests for Personal Information from you to help DF tailor the Site for you and deliver personalized information to you. You may request changes to or the removal of your Submitted Information by contacting DF at legalnotice@omidyar.com. If DF agrees to remove such Submitted Information, you acknowledge and agree that DF may continue to retain such Submitted Information in its archives and backup locations, until such archives or backups are destroyed or overwritten. You agree not to submit Personal Information about others without their prior written consent.

Browsing Information. When you use the Site, DF or DF’s servers (which may be hosted by a third party service provider) collect information automatically about your activities while using the Site (“Browsing Information”). Browsing Information may include the web pages you view, the times you view them, the search terms you use, information about the browser you are using as well as your IP address. An IP address is a number that identifies your computer’s location on the Internet and may be automatically assigned to your computer when you use the Internet. DF may also use “cookies” or other tracking mechanisms in connection with the collection of Browsing Information. A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer’s hard drive. DF may, in the future, collect other Browsing Information from you to help us tailor the Site for you and deliver personalized information to you. Your Personal Information may be linked to your Browsing Information.

Use of Information.

DF may use your Submitted Information and Browsing Information to send you emails that you have requested and for general administrative, technical, marketing, human resource, legal and other purposes related to our operations.

Disclosure of Personal Information.

Except as otherwise noted below, we do not disclose Personal Information to non-affiliated third parties. We may disclose Personal Information to non-affiliated third parties: (i) to fulfill specific requests that you have submitted; (ii) to provide, maintain, enhance, or add to the functionality of the Site; (iii) when required by law or under the good-faith belief that such disclosure is necessary in order to conform to applicable law, comply with subpoenas, court orders or legal process served on DF; or (iv) to establish or exercise DF’s legal rights or defend against legal claims, and to protect the property or interests of DF and its officers, directors, agents, employees, grantees, and the public. Under certain circumstances, DF may be prohibited by law, court order or other legal process from providing notice of the disclosure, and DF reserves the right to not provide such notice in its sole discretion.

DF cannot ensure that your Personal Information will not be disclosed to non-affiliated third parties due to reasons beyond its reasonable control.

We may disclose Personal Information to affiliates and we may disclose Browsing Information and/or aggregated information that does not include individual Personal Information to third parties.

DF may transfer Personal Information and Browsing Information if DF is acquired by or merged with a third party. In this event, DF will provide notice on the Site prior to such transfer of Personal Information and Browsing Information.

DF may have operations in various countries, and you acknowledge and agree that DF may transfer your Personal Information worldwide, so long as such transfer is otherwise in compliance with this Privacy Policy.

Updates to Privacy Policy.

We may update this Privacy Policy from time to time as the Site changes. If we update this Privacy Policy, we will post the updated Privacy Policy on the Site. Unless otherwise provided, the revised terms will take effect on the date they are posted. Once such changes become effective, your continued use of the Site will signify your acceptance of the new Privacy Policy. If you do not agree to the terms of this Privacy Policy, or any revised Privacy Policy, your sole and exclusive remedy is to discontinue using the Site.

Third Party Information, Services and Tools.

The Site contains information, services and tools provided by third parties, whether through embedded modules, links or other technologies. Use of such information, services and tools may be governed by the privacy policies of such third parties and not DF. Please refer to such third parties for their privacy policy to determine how they collect, use and disclose your information.

IMPORTANT: PLEASE READ THIS TERMS OF USE AGREEMENT CAREFULLY. YOUR USE OF THIS WEBSITE AND ASSOCIATED SERVICES, MEDIA, MATERIALS, AND OTHER INFORMATION IS CONDITIONED UPON YOUR COMPLIANCE WITH AND ACCEPTANCE OF THESE TERMS.

We want you to fully understand the terms and conditions of using this website, democracyfund.org (the “Site”), and the associated services, media, materials and other information (the “Site Content”). This Terms of Use Agreement (this “Agreement”) is a legal agreement between you (either an individual or entity) and Democracy Fund, Inc., for use of the Site and the Site Content. By using or accessing the Site, you agree to be bound by and a party to this Agreement.

The Site contains information regarding Democracy Fund, Inc. and its affiliates (collectively, “DF”). Furthermore, certain Site Content, including information, services, tools and links, may be provided by third parties. You acknowledge and agree that DF is not responsible or liable for: (i) the availability or accuracy of any Site Content, whether provided by DF or third parties; (ii) the content, advertising, products or services on or available from third parties whether through embedded modules, linked websites or otherwise; or (iii) the terms of use or privacy policy governing use of any embedded modules or linked websites. The inclusion of any information, embedded service or link through the Site does not imply that DF endorses the information, embedded service or linked website. DF assumes no responsibility for the content provided through the Site or of such other third party service providers or websites and will not be liable for any damages or injury arising from your use or reliance upon such content or your access to, or inability to access, such information, services or websites. DF does not and cannot review all materials posted to the Site by its users, and DF is not responsible for any such materials posted by users. 2. RIGHT TO USE. Subject to the terms and conditions of this Agreement, DF grants you the right to use the Site and the Site Content, in accordance with this Agreement. Please see the Copyright Notice posted on the Site and incorporated by reference herein for information regarding any additional license rights to Site Content. Any rights not expressly granted herein or in the Copyright Notice are reserved by DF and its third party licensors. Notwithstanding the foregoing, DF reserves the right to limit the availability of the Site and the Site Content to any person, group, geographic area or jurisdiction, at any time. If you access the Site from outside the U.S., you do so at your own risk and you are responsible for compliance with any local laws.

The Site Content is protected by copyright as a collective work and compilation under U.S. copyright laws, international conventions, and other copyright laws. All materials contained on the Site are protected by copyright and are owned or controlled by DF or the party credited as the provider of the content. 3. CONDUCT. You agree that you will not:

  • Use the Site or any Site Content for any unlawful purpose;
  • Submit, post or transmit any defamatory, libelous, abusive, harassing, obscene, indecent, threatening or illegal material, or any material that infringes the rights (including the intellectual property rights) of others, to or through the Site;
  • Use the Site or any Site Content to send unsolicited mass mailings, email, junk mail, “spam”, chain letters or promotions or advertisements for products or services, or otherwise inappropriate commercial communications;
  • “Frame” or “mirror” any part of the Site without our prior written authorization;
  • Forge any TCP/IP packet header or any part of the header information in any email, content/information/data submitted on or through the Site, or in any way use the Site or Site Content to send altered, deceptive or false source-identifying information, or other false, fraudulent, inaccurate or misleading information or communications;
  • Interfere with, or attempt to interfere with, the access of any Site user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Site;
  • Access, tamper with, or use, without authorization, non-public areas of the Site, DF’s computer systems or the technical delivery systems of DF’s providers;
  • Attempt to probe, scan, or test the vulnerability of any system or network used for the Site or breach any security or authentication measures for such systems and networks;
  • Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Site or Site Content;
  • Attempt to access or search the Site or Site Content with any engine, software, tool, agent, device or mechanism other than the software and/or search agents provided by DF or other generally available third party web browsers (such as Firefox or Internet Explorer);
  • Impersonate or misrepresent your affiliation with any person or entity to DF or on or through the Site; or
  • Express or imply that any statement you make is endorsed by us, without our prior written consent.

4. JOBS. The Site may contain postings for job positions available at DF and/or Grantees. Such information may not be up-to-date, accurate or complete. Not all jobs may be posted on the Site. DF and each Grantee reserves the right to change or correct its job descriptions or postings at any time, even if you have already applied. You acknowledge and agree that DF and Grantees do not pay commissions or referral fees to anyone who helps arrange a job placement unless you have an express written contract with DF or the Grantee, as applicable, regarding such commission or referral fee prior to any such arrangement. Any resume or other personal information submitted to DF in response to a DF job posting will be handled in accordance with the Privacy Policy posted on the Site and incorporated herein by reference (“Privacy Policy”). Any resume or other personal information submitted in response to a Grantee job posting will be forwarded to such Grantee by DF or a third party service provider. You acknowledge and agree that the privacy policy of such Grantee shall govern the handling of any such resume and information after it has been submitted to such Grantee, and not the DF Privacy Policy.

5. BUSINESS PLANS AND OTHER PROPOSALS. DF does not accept unsolicited business plans or other proposals, and takes no responsibility and assumes no liability if you submit any such business plan or proposal to DF. You acknowledge and agree that DF does not have any confidentiality or other obligations with respect to any such information or materials, regardless of whether such information or materials are marked or identified as confidential or proprietary.

6. RESPONSIBILITY FOR YOUR CONTENT AND COMMUNICATIONS. You agree that you are solely responsible for any content, feedback and communications (visual, written or audible) sent by you to or through the Site, and you agree that DF may use, reproduce, modify, create derivative works of, display, perform and/or distribute any such content, feedback or communication that you submit or post on the Site as DF deems necessary in its reasonable discretion, provided that use and/or distribution of personal information shall be in accordance with the Privacy Policy.

Although DF is not responsible for your content or communications, DF may delete any such content or communications, at any time without notice to you or anyone else. You are solely responsible for any information that you submit or post on the Site. DF retains the right to deny access to anyone who DF believes has violated the terms of this Agreement. DF further reserves the right to investigate and prosecute violations of this Agreement, including those related to intellectual property rights and security issues, to the fullest extent of the law. DF may involve and cooperate with law enforcement authorities in prosecuting users who violate this Agreement.

Transmissions to and from the Site may be read or intercepted by others. You acknowledge that by submitting communications to the Site, no confidential, fiduciary, contractually implied, or other relationship is created between you and DF other than in accordance with this Agreement and DF’s Privacy Policy.

7. DIGITAL MILLENNIUM COPYRIGHT ACT COMPLIANCE. DF respects the intellectual property rights of others and expects users of the Site to do the same. Pursuant to 17 United States Code 512(c)(2) (Digital Millennium Copyright Act of 1998), DF’s designated agent for notice of alleged copyright infringement appearing on the Site is:

Filing a notice of infringement with DF requires compliance with the requirements specified in Title II of the Digital Millennium Copyright Act of 1998.

8. PRIVACY. The Privacy Policy is posted on the Site, and is incorporated herein by reference. Please consult it to learn DF’s current policies to protect the privacy of your information.

9. EXPORT RESTRICTIONS. You acknowledge that the Site and the Site Content may be subject to the export control laws of the United States. You will not export, re-export, divert, transfer or disclose any portion of the Site, the Site Content or any related technical information or materials, directly or indirectly, in violation of any applicable export law or regulation.

10. INJUNCTIVE RELIEF. You acknowledge that any use of the Site or Site Content contrary to this Agreement may cause irreparable injury to DF and its third party licensors, and under such circumstances DF and its third party licensors will be entitled to equitable relief, without posting bond or other security, including, but not limited to, preliminary and permanent injunctive relief.

11. NO WARRANTIES. YOU UNDERSTAND AND AGREE THAT THE SITE AND THE SITE CONTENT ARE PROVIDED “AS IS” AND DF, ITS SUPPLIERS AND PARTNERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF TRADE. DF AND ITS THIRD PARTY LICENSORS MAKE NO WARRANTY OR REPRESENTATION REGARDING THE ACCURACY OR RELIABILITY OF ANY SITE CONTENT, OR THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR FREE, OR OTHERWISE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. USE OF THE SITE IS AT YOUR SOLE RISK.

12. INDEMNIFICATION. You agree to indemnify and hold harmless DF and its officers, directors, employees, consultants, agents and third party licensors from any and all claims, liability, damages and/or costs (including, but not limited to, attorneys fees) arising from your use of the Site, your content, feedback or communications submitted to or through the Site, or your violation of this Agreement.

13. LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DF OR ITS THIRD PARTY LICENSORS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, OR ANY OTHER PECUNIARY LOSS OR DAMAGE) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SITE OR ANY SITE CONTENT, WHETHER ARISING IN TORT (INCLUDING NEGLIGENCE), CONTRACT OR ANY OTHER LEGAL THEORY, EVEN IF DF OR ITS THIRD PARTY LICENSORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE MAXIMUM CUMULATIVE LIABILITY OF DF AND ITS THIRD PARTY LICENSORS EXCEED $50 OR THE AMOUNT ACTUALLY PAID BY YOU TO USE THE SITE (IF ANY), WHICHEVER IS GREATER, AND THIS AMOUNT SHALL BE YOUR EXCLUSIVE REMEDY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT, THE SITE OR ANY SITE CONTENT. THE LIABILITY LIMITATIONS SET FORTH IN THIS AGREEMENT SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY EXCLUSIVE REMEDY PROVIDED IN THIS AGREEMENT OR THE INVALIDITY OF ANY OTHER PROVISION. Because some states and jurisdictions do not allow the exclusion or limitation of liability, the above limitation may not apply to you.

14. MISCELLANEOUS.

a. Choice of Law and Forum. This Agreement shall be governed by and construed under the laws of the State of Delaware, U.S.A., without reference to its conflict of laws provisions. The parties consent to the exclusive jurisdiction and venue of the courts located in and/or serving Washington, D.C.

b. Waiver and Severability. Failure by either party to exercise any of its rights under, or to enforce any provision of, this Agreement will not be deemed a waiver or forfeiture of such rights or ability to enforce such provision. If any provision of this Agreement is held by a court of competent jurisdiction to be illegal, invalid or unenforceable, that provision will be amended to achieve as nearly as possible the same economic effect of the original provision and the remainder of this Agreement will remain in full force and effect.

c. General Provisions. This Agreement (including the Privacy Policy, any other documents incorporated by reference herein and any modifications hereof) embodies the entire understanding and agreement between the parties respecting the subject matter of this Agreement and supersedes any and all prior understandings and agreements between the parties respecting such subject matter. DF may change the terms of this Agreement at any time by posting modified terms on the Site. Your continued use of the Site after such posting will be deemed acceptance of the changes. This Agreement has been prepared in the English Language and such version shall be controlling in all respects and any non-English version of this Agreement is solely for accommodation purposes. All notices or other correspondence to DF under this Agreement except for notices described in Paragraph 7 hereof must be sent to Democracy Fund, Inc., Attn: President, 1333 New Hampshire Avenue, Suite 730, Washington, DC 20036, or sent via email to notice@democracyfund.org. Any and all rights and remedies of DF and its third party licensors upon your breach or other default under this Agreement will be deemed cumulative and not exclusive of any other right or remedy conferred by this Agreement or by law or equity on DF and its third party licensors, and the exercise of any one remedy will not preclude the exercise of any other.
